gmail-mcp-oauth Terms of Service

These Terms of Service ("Terms") govern your use of gmail-mcp-oauth ("the service"), an OAuth-authenticated Model Context Protocol (MCP) server that connects to the Google Gmail API on your behalf, operated by Welch Commerce Systems, a DBA of Welch Products LLC ("Welch Commerce Systems," "we," "us," or "our"). By linking a Google account to the service or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service.

gmail-mcp-oauth lets an MCP client you connect call the Google Gmail API on your behalf, using OAuth credentials you grant. The service is provided as open-source software and is offered to you free of charge, on an "as is" basis.

You may use the service only if you are able to form a binding contract and are of the age of majority in your jurisdiction. You may link a Google account only if you own it or are authorized to access it. You are responsible for the MCP clients you connect and for activity that occurs through your linked accounts.

Your use of Gmail through the service is also governed by Google's own terms, including the Google Terms of Service and the Gmail program policies. The service's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. You can review and revoke the service's access to your Google account at any time at myaccount.google.com/permissions.

Our handling of your data is described in our Privacy Policy, which is incorporated into these Terms by reference.

6. Open-source software and license

gmail-mcp-oauth is open-source software released under the MIT License. The source code is available at github.com/ToddWelch/gmail-mcp-oauth. Your rights to use, copy, modify, and distribute the source code are governed by that license. If you deploy your own instance of the software, you are responsible for that deployment, and these Terms govern only the instance operated by Welch Commerce Systems.

7. Disclaimer of warranties

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.

8. Limitation of liability

To the maximum extent permitted by law, Welch Commerce Systems and Welch Products LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising out of or related to your use of the service. The service is offered free of charge, and our total liability for any claim relating to the service is limited to one hundred U.S. dollars ($100).

9. Indemnification

You agree to indemnify and hold harmless Welch Commerce Systems and Welch Products LLC from any claims, damages, or expenses arising out of your use of the service or your violation of these Terms.

10. Suspension and termination

You may stop using the service at any time by unlinking your accounts and revoking access from your Google Account. We may suspend or terminate access to the service, in whole or in part, at any time, including to protect the security or integrity of the service.

11. Changes to these Terms

We may update these Terms from time to time. We will post the updated version at this same URL and revise the "Last updated" date above. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the United States and of the state in which Welch Products LLC is established, without regard to its conflict-of-laws rules.
